Marcos asks Ombudsman to investigate five-high ranking officials over Duterte arrest

Senator Imee Marcos formally asked the Office of the Ombudsman to conduct an investigation against five high-ranking government officials for violating Philippine and international law involved in the arrest of former President Rodrigo Duterte by the International Criminal Court last March 11.

The high ranking officials were Justice Secretary Jesus Crispin Remulla, Criminal Investigation and Detection Group (CIDG) Chief General Nicolas Torre III, Philippine National Police (PNP) Chief General Rommel Francisco Marbil, Interior and Local Government Secretary Juanito Victor Remulla and Special Envoy on Transnational Crime Markus Lacanilao.

In her letter to Ombudsman Samuel Martires, Marcos stressed that "during the course of the Senate inquiry, the Committee on Foreign Relations uncovered acts by high-ranking government officials which very likely constitute criminal and administrative offenses."

"Thus, I am requesting that these officials, all of whom are named in the Report, be investigated, and where appropriate, prosecuted and/or sanctioned in accordance with the applicable laws, rules, and regulations," said Marcos, chairman of the Senate Committee on Foreign Relations.

Marcos submitted the chairman's report of the Senate Committee of Foreign Relations to the Office of the Ombudsman on Friday.

"I am transmitting the Chairman's report which is the result of the Senate investigation of the arrest and extraordinary rendition of former President Rodrigo Duterte. He was brought to The Hague and it looked like a lot of violations to the constitution and international law were committed," she told reporters in an interview in Quezon City.

It said Justice Secretary "Remulla is liable for usurpation of judicial functions under Article 241 of the RPC (Revised Penal Code) and for violation of RA No. 3019 or the Anti-Graft and Corrupt Practices Act."

"There is likewise reason to believe that SOJ (Secretary of Justice) Remulla is liable for the administrative offense of Grave Misconduct & Conduct Prejudicial to the Best Interest of the Service," the report said.

Torre is allegedly "liable for Arbitrary Detention (RPC, Art. 124); Violation of RA No. 7438; Violation of RA No. 3019; Grave Threats under Article 282 of the RPC; Grave Misconduct, and Conduct prejudicial to the Best Interest of the Service" while Marbil is also responsible for "Arbitrary Detention (RPC Art. 124), Violation of RA No. 3019, Grave Misconduct, and Conduct prejudicial to the Best Interest of the Service."

It also states that Interview and Local Government Secretary Jonvic Remulla "should be held criminally liable for violation of RA No. 3019 and Arbitrary Detention. He should also be held accountable for Grave Misconduct and Conduct Prejudicial to the Best Interest of the Service".

Lacanilao "should be held accountable for usurpation of Official Functions (RPC Article 177); False Testimony in Other Cases and Perjury in Solemn Affirmation, Grave Misconduct, and Conduct Prejudicial to the Best Interest of the Service." Robina Asido/DMS
