The House of Representatives will file a motion for reconsideration before the Supreme Court after the High Tribunal last Friday unanimously ruled the impeachment complaint against Vice President Sara Duterte was unconstitutional.
The Court said the House of Representatives did not hear three prior impeachment complaint submitted in December 2024 and instead chose to use the fourth impeachment on February 2025. The one-year bar against filing a complaint had kicked in in December.
House spokesperson Princess Abante did not say when the House of Representatives will file the motion for reconsideration.
''There were factual details that were not taken into consideration by the Supreme Court when it said that the impeachment complaint was not approved by the plenary. These are all in the official records of the House of Representatives,'' she told dzBB Sunday.
''We will file the motion for reconsideration so the Court will be clarified. These records were included when the impeachment was filed but it seems these were not considered. That is why we are filing the motion for consideration to give the House of Representatives a chance to explain the process,'' she added.
Abante said according to the rules they will be given 15 days to file a motion for reconsideration.
Abante said the Supreme Court explained that the February 5 impeachment complaint was transmitted to the Senate without a plenary vote.
''This is categorically false. On February 5, Majority Leader Mannix Dalipe moved to pass the impeachment complaint to House. This is verified and signed by no lower than one-third of the members. This motion was approved by the House and a panel of public prosecutors was formed,'' said Abante in a video message.
The Senate, after it begin sessions on Monday morning, is expected to vote on whether to continue the impeachment court hearing following the SC decision. DMS
