Vice President Sara Duterte filed a petition for certiorari and prohibition against her impeachment complaint before the Supreme Court (SC) on Tuesday.

The petition seeks "to issue a writ of certiorari to nullify the fourth impeachment complaint filed by 215 members of the House of Representatives on February 5, 2025 for violating Section 3 (5), Article XI of the Constitution " .

It was filed on Tuesday but was not included in their en banc agenda on the same day, SC spokesperson Camille Ting told reporters.

Respondents of the petition are House Speaker Ferdinand Martin Romualdez, House Secretary General Reginald Velasco, and Senate President Francis Escudero.

Meanwhile, Escudero said in a press briefing on Wednesday that they referred the order of the Supreme Court to the Solicitor's General Office being legal counsel of the government.

"So the Senate will not comment nor prepare to respond to it. The SolGen (Solicitor General) will stand as the legal counsel of the government", Escudero added.

This follows the order of the SC for the Senate to comment within 10 days on the petition filed seeking the immediate impeachment trial against Duterte. Marie Manalili/DMS
