The Supreme Court (SC) did not release a temporary restraining order after lawyers of former President Rodrigo Duterte and Senator Ronald dela Rosa filed a petition on Tuesday afternoon.

In a statement on Wednesday, the 94-page Petition for Certiorari and Prohibition with Prayer for the Issuance of Temporary Restraining (TRO) and/or Writ of Preliminary Prohibitory and Mandatory Injunction against Executive Secretary Lucas Bersamin, et al., did not establish a clear right for the issuance of a TRO.

"After a virtual deliberation on the 94-page petition, the SC found that the petitioners failed to establish a clear and unmistakable right for the issuance of a TRO", the SC said in a statement.

The respondents of the petition were ordered by SC to comment on the petition within a non-extendible period of 10 days from notice.

Meanwhile, two separate habeas corpus petitions were filed by the children of Duterte before the High Court on Wednesday.

The petitions that seek the return of Duterte to the country were filed by Veronica Duterte and Davao Mayor Sebastian Duterte, children of the former President. Both were represented by their lawyers.

Chief Justice Alexander Gesmundo, in a statement, ordered a special raffle for both petitions.

In a television interview, former Labor Secretary Silvestre Bello III said that he thinks the petition is not workable as the former President was flown out of the country. Marie Manalili/DMS
