One of the victims in Sunday afternoon's road rage incident in Antipolo City has died with police set to upgrade the charge against the suspect to murder, police said.

In a Facebook live broadcast on Monday evening, Antipolo chief of police Lt. Col. Ryan Manongdo said that alias “Peter”, 52, lost his life after succumbing to a gunshot wound to the head.

Manongdo said that the multiple counts of frustrated murder and violation of gun ban filed before the office of prosecutor against the suspect, "Kenneth", 28, will be "upgraded" on Wednesday.

"We will upgrade it to murder and two counts of frustrated murder including the gun ban", he said.

"One of the victims died so the three counts of frustrated murder that we filed this (Monday) afternoon will be upgraded. We will amend it since the victim who was shot in the head, the one we saw (in the video) lying down, has died", Manongdo added.

Earlier reports said that one of the victims were discharged while the remaining two are under observation.

The incident occurred on Sunday afternoon along Marcos Highway in front of Cafe Sinauna, Sitio Calumpang, Barangay San Jose, Antipolo City after the suspect opened fire injuring four individuals, including the suspect's partner. The suspect was arrested by authorities in a hot pursuit operation on the same day. Marie Manalili/DMS
